Right of withdrawal
You may withdraw from this contract within fourteen days without stating a reason. The withdrawal period is fourteen days from the date the contract is concluded.
Exercising the right of withdrawal
To exercise your right of withdrawal, notify us, Marko Leßenich, sole proprietor trading as DataDoc, Diemelweg 23, 50765 Cologne, Germany, telephone +49 151 677 094 75, email info@datadoc-repair.com, of your decision to withdraw from this contract by a clear statement, for example in a letter sent by post or by email. You may use the model withdrawal form below, but you are not required to do so.
You may also exercise your right of withdrawal using our continuously accessible electronic function, Withdraw from contract. If you use this function, we will promptly email you an acknowledgement containing your withdrawal statement and the date and time it was received.
To comply with the withdrawal deadline, you only need to send the communication exercising your right before the withdrawal period expires. Where possible, please provide your DataDoc case number so that we can identify the contract reliably.
Effects of withdrawal
If you withdraw from this contract, we will refund all payments received under this contract, including the cost of an offered standard delivery, promptly and no later than fourteen days from the date we receive your withdrawal statement. This excludes additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by DataDoc. We will use the same payment method you used for the original payment unless another method has been expressly agreed. You will not be charged any fees for the refund.
Compensation where services start early
If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already supplied up to the time you notify us that you are exercising your right of withdrawal from this contract, relative to the full scope of services provided for in the contract.
Compensation requires, in particular, your express request for an early start and the proper information required by law. For contracts concluded away from business premises, the request must be communicated on a durable medium. Withdrawal does not automatically make a diagnosis fee or return-shipping flat rate payable; any compensation is assessed separately for the particular contract.
Expiry of the right of withdrawal
For a paid service, the right of withdrawal expires before the end of the fourteen-day period only if DataDoc has fully performed the service and, before performance began, you expressly consented to DataDoc starting the service before the withdrawal period expired and at the same time acknowledged that your right of withdrawal would expire upon full performance of the contract.
Devices and storage media already sent in
Withdrawal ends the service order to the extent that services remain outstanding. DataDoc stops technically hazardous work in a controlled manner and then agrees with you how the device or storage medium you submitted will be collected or returned. Collection from the DataDoc premises is free of charge after an appointment has been confirmed. If you request return shipping, we will agree the return arrangements and any legally permissible costs with you individually in advance. Withdrawal does not create an automatic shipping or handling flat fee. Any compensation legally payable for services already performed is assessed separately under the conditions described above.
The shipping costs without a follow-up order set out in the terms and conditions concern rejection of the fixed-price offer prepared after diagnosis. They do not arise automatically as a consequence of a valid withdrawal.
